On Thursday, November 4, 2021, OSHA announced its long-awaited COVID-19 Vaccination and Testing Emergency Temporary Standard (ETS). The ETS requirements will be explained during the webinar, some of which are effective December 5, 2021 and others are effective January 4, 2022.
On Saturday, November 6, 2021, the United States Court of Appeals for the Fifth Circuit temporarily stayed the implementation and enforcement of the ETS citing “grave statutory and constitutional issues with the Mandate.” Although the ETS currently affects employers with 100 or more employees, we recommend that smaller employers also consider attending the webinar. During the webinar, Masuda Funai attorneys will address the following:
- The purpose, scope and application of the ETS
- Implementing and enforcing the required written vaccination policy
- Determining and recording every employee’s vaccination status
- Providing paid time off to obtain a vaccination
- Testing, face mask, and record retention requirements
- Penalties for non-compliance
