Ed Underhill's UCC Article Featured in the Illinois Bar Journal
The June issue of the Illinois Bar Journal featured Ed Underhill's article entitled What's in a Name? For UCC Filings Under Revised Article 9, Everything. The article discusses recent court opinions holding that even slight misspellings or minor misidentification of the debtor's name on a financing statement will render the filing ineffective. His article also offers practical advice on how secured creditors can make sure they are not putting valuable equipment/collateral at risk by improperly identifying their customers.
Mr. Underhill is a senior Principal in the Litigation and Distribution & Sales Practice Groups of Masuda Funai.
He primarily represents businesses in commercial transactions and disputes. As a business attorney, with a focus on litigation, he has represented clients throughout the United States
